End-User License Agreement (EULA)
Please read this End-User License Agreement (“Agreement”) carefully before clicking the “I Agree” button, downloading, or using the Herbology NYC application.
Interpretation and Definitions
Interpretation
Words with capitalized first letters have specific meanings as outlined below. These definitions apply whether the terms appear in singular or plural form.
Definitions
- Agreement – This End-User License Agreement constitutes the entire agreement between you and Herbology NYC concerning the application.
- Application – The software program provided by Herbology NYC, downloaded through an application store to a device, named Herbology NYC App.
- Application Store – The digital distribution service operated by Apple Inc. (Apple App Store) or Google Inc. (Google Play Store) where the application is available.
- Company (referred to as “We,” “Us,” or “Our”) – Herbology NYC, located at [Company Address].
- Content – Any text, images, or other materials posted, uploaded, linked, or otherwise made available through the application.
- Device – Any device, including computers, mobile phones, or tablets, capable of running the application.
- Third-Party Services – Any services or content provided by third parties that are displayed, included, or made available by the application.
- You – The individual or entity accessing or using the application.
Acknowledgment
By downloading, installing, or using the application, you agree to be bound by the terms of this Agreement. If you do not agree, do not use the application.
This Agreement is solely between you and Herbology NYC, not the application store. However, the application store may enforce its terms concerning your use of the application.
The application is licensed, not sold, to you by the company for use strictly in accordance with the terms of this Agreement.
License
Scope of License
Herbology NYC grants you a revocable, non-exclusive, non-transferable, limited license to install and use the application strictly in accordance with this Agreement.
License Restrictions
You agree not to:
- Sell, lease, assign, distribute, or commercially exploit the application.
- Modify, reverse-engineer, or create derivative works of the application.
- Remove or alter any copyright or proprietary notices.
Content Restrictions
You are solely responsible for any content you upload, post, or share through the application. You may not share content that is unlawful, offensive, or violates intellectual property rights.
We reserve the right to remove any content that we determine violates this Agreement.
Intellectual Property
The application and all associated copyrights, trademarks, and intellectual property rights remain the exclusive property of Herbology NYC.
Modifications & Updates
We may modify or discontinue the application without notice. Updates may add, modify, or remove functionalities without liability.
Third-Party Services
Our application may contain links to third-party services, which are not governed by this Agreement. We are not responsible for any third-party services you use.
Privacy Policy
We collect, store, and use information per our Privacy Policy. By using the application, you agree to our Privacy Policy.
Termination
This Agreement remains in effect until terminated by you or the company. We may terminate this Agreement immediately if you violate any of its provisions.
Upon termination, you must stop using and delete all copies of the application.
Limitation of Liability
To the fullest extent permitted by law, Herbology NYC shall not be liable for any indirect, incidental, or consequential damages arising from the use of the application.
Governing Law
This Agreement shall be governed by and interpreted according to the laws of New York State. Any disputes arising under this Agreement shall be resolved in the courts of New York.
